本文在对无效婚姻中善意当事人保护制度建立的基本理论及意义分析的基础上,阐述现代各国对无效婚姻中善意当事人的各类保护制度,特别是推定配偶制度,同时借鉴外国的立法经验,结合我国的现实状况提出完善我国无效婚姻中善意当事人保护制度的相关立法意见,包括树立制裁与救济并行的立法理念、给予善意当事人的一定的权利以及建立对生活困难一方相应的救济制度.
